Traveling With Firearms: Airports and Other States

A Florida gun owner who travels leaves one set of rules and enters another. Some of the harshest outcomes in gun cases happen to people who did nothing wrong at home.

This page is general education. Check the law at every stop on your route.

The most important rule

Your Florida rights do not travel with you.

Each state decides who may carry, where, and how. A rule you rely on in Florida may be a crime one state north.

Plan the trip before you pack the gun. If you cannot learn the rules for a state, leave the gun at home.

Flying

Airlines allow firearms only as checked baggage, and only under strict conditions. In general:

  • The firearm must be unloaded.
  • It goes in a hard-sided case that is locked.
  • You declare it at the ticket counter.
  • Ammunition must be packed as the airline requires.
  • Only you should keep the key or combination to the lock.

Airline and TSA rules are specific, and they change. Read the carrier's policy and the TSA guidance before you arrive.

Never bring a gun to a security checkpoint or onto the plane. TSA rules bar a firearm in the sterile area. Federal law makes it a crime, punishable by up to ten years in prison, to board or try to board an aircraft with a concealed dangerous weapon that would be accessible to you in flight. At the least, expect a missed flight.

Florida airports

Florida bans firearms inside the whole passenger terminal, including the sterile area. The statute has an exception for a firearm that is encased and being checked as baggage.

That means the walk from the curb to the ticket counter is where the law matters most. Keep the case closed and the gun unloaded until you are in the right place.

Do not carry a loaded gun into a Florida airport terminal, even with a license.

Driving across state lines

Federal law has a safe-passage rule for travelers. It can protect a person who is moving a firearm through a state where it would otherwise be illegal, if every condition is met.

The firearm must be unloaded. Neither the firearm nor any ammunition may be readily accessible, or directly accessible from the passenger compartment. In a vehicle with no compartment separate from the driver's compartment, the firearm and ammunition must be in a locked container other than the glove compartment or console.

You also have to be lawfully allowed to possess and carry the gun where you started and where you are going, and not be otherwise barred.

This rule has limits. Some states and local police read it narrowly, and it protects only a traveler who meets every condition. A stop where you may not have the gun, or a gun you can reach, can cost you the protection.

The safest practice is to drive straight through, keep everything locked in the trunk, and avoid stops in states with strict rules.

Carry licenses in other states

Florida lets a nonresident who is a U.S. resident aged 21 or older carry concealed here if he or she holds a valid license from his or her home state and has it in immediate possession, or meets Florida's license criteria. A nonresident has the same restrictions as a Florida resident. The age rule does not apply to servicemembers or honorably discharged veterans.

Whether another state honors a Florida license is that state's decision. Many do not, and some honor it only for certain people. Do not rely on a list you saw online. Check the official source for each state before you carry.

The same applies to carrying without a license. A state that allows it for its own residents may not extend it to visitors.

States with strict rules

A few states and cities treat unlicensed gun possession as a serious crime, with severe penalties, whatever your intent.

If your route crosses one, ask yourself whether the trip needs a gun. In those places a first offense can mean jail, and the outcome may not turn on whether you were careful.

Federal property

Federal law makes it a crime to knowingly possess a firearm or other dangerous weapon in a federal facility, with limited exceptions. Federal court facilities are covered by a separate provision.

A Florida license does not change this. Check the rules before you enter any federal building.

Cruise ships and other countries

Do not take a firearm onto a cruise ship, and do not bring one to another country without lawful permission in advance.

Foreign countries treat gun possession harshly. Visitors have been jailed for ammunition left in a bag. A short trip can become a long prosecution.

Trains, buses, and rideshare

Rules differ by carrier. Some allow checked firearms with advance notice. Others bar them. Ask before you buy a ticket.

Hotels and rentals

Private property owners may set their own rules. A hotel or rental host may ban firearms on the premises. Violating those rules can lead to eviction or trespass, and sometimes a criminal charge.

Keep the gun locked and out of sight when you leave your room.

A short checklist

  1. Know the rules for every state on your route.
  2. Unload the gun and lock it in a hard case.
  3. Keep ammunition out of reach, and separate if you can.
  4. Use the trunk. Do not keep the case within reach.
  5. Avoid unnecessary stops in strict states.
  6. Carry your identification and documents.
  7. Tell no one more than you have to.
