Frequently asked questions

How do I set a special set hearing before Judge Martinez-Scanziani?

The page says motions and requests for hearing for any matter needing a special set must be filed with the Clerk of the Court and Comptroller of Miami-Dade County. A courtesy copy should be emailed to the Judicial Assistant, and the moving party prepares the Notice of Hearing once the Judicial Assistant confirms the date and time.

Where is Judge Martinez-Scanziani's courtroom?

The page lists Room MDCC 14356 at the Miami-Dade Children's Courthouse. Delinquency detention and dependency shelter hearings are heard in Courtroom 2-1 at the same courthouse, and the judge has that duty only on her assigned weeks.

What is the deadline for a motion to modify placement in an open dependency case?

The page says the motion must be filed no later than 11:00 a.m. to be heard the same day at 2:00 p.m. Otherwise it is calendared on the next day's shelter rotation calendar at 10:30 a.m. The page also says that filing with the Clerk alone is not enough to get the case on the calendar.

Where do I file motions and requests for hearing?

The page says all motions and requests for hearing must be filed at the Children's Courthouse, 155 NW 3rd Street, 3rd Floor, Miami. Self-represented litigants may also seek help from the Family Court Self Help Program at 175 NW 1st Avenue, 24th Floor.
