Understanding Various Types of Insurance Fraud

Numerous forms of insurance fraud exist, most of which are felony charges in Florida. Common instances include fraudulent motor vehicle accident claims, workers' compensation fraud, healthcare insurance fraud, homeowners insurance fraud, commercial insurance fraud, disability fraud, arson, and life insurance fraud. In all these cases, the defendant is accused of intentionally providing false or misleading statements in support of an insurance claim. Such statements can be made during the initial application process or while filing the claim.

How Florida Charges Insurance Fraud

State prosecutors usually file insurance fraud charges under Florida Statute, Section 817.234, unless a more specific law applies, like workers' compensation fraud. If multiple insurance fraud counts are alleged as part of an organized scheme, the prosecutor can also charge the defendant under Florida’s organized fraud statute.

Punishments for Insurance Fraud in Florida

The severity of the potential sentence for an insurance fraud charge depends on the amount of money involved:
  • $19,999 or less — a third-degree felony, punishable by up to 5 years in prison.
  • $20,000 or more, but less than $100,000 — a second-degree felony, punishable by up to 15 years in prison.
  • $100,000 or more — a first-degree felony, punishable by up to 30 years in prison.

Three scenarios where an innocent person may be wrongfully accused of Insurance Claims Fraud:

  1. Mistaken Identity: An individual could be wrongfully accused of making a fraudulent insurance claim if their personal information, such as name, address, or Social Security number, was used by someone else without their knowledge. This could lead to a case of mistaken identity, where the innocent person is accused of insurance fraud while the real perpetrator goes unnoticed.
  2. Miscommunication or Clerical Error: In some cases, an innocent person could be accused of insurance fraud due to a miscommunication or clerical error made by the insurance company or a third party, such as a medical provider. For example, if a healthcare provider accidentally submits duplicate bills or mistakenly bills for services that were not rendered, the policyholder may be accused of insurance fraud, even though they had no knowledge of the mistake.
  3. Unintentional False Information: An individual may provide inaccurate information when filing an insurance claim without realizing it. For example, they may incorrectly estimate the value of damaged or stolen property, or unknowingly provide incorrect information about the circumstances surrounding an accident. While the person may have had no intention of committing fraud, their unintentional errors could lead to accusations of insurance fraud.

What Our Clients Are Saying

"I was unjustly charged with a Felony for taking back one of my employees mobile phones after she was dismissed from her post. She called police. They arrested me, charged me with Strong Arm Robbery and I spent the next two days in jail. I hired Dennis when I was released. He took over and turned a Felony into a Misdemeanor, then a Dismissal! Thanks Dennis, for finding justice in this case!!"
