Civil Procedures

Once the Defendant(s) appear(s) in the action, the parties shall prepare and file a joint scheduling report and a proposed scheduling order. A sample proposed scheduling order, in the Court’s preferred format, is attached. The parties shall e-mail their proposed scheduling order, in word format, to the Court at gayles@flsd.uscourts.gov.

Unless otherwise specified by the Court, every motion, response, and reply shall be double-spaced in Times New Roman 12-point typeface. Multiple Plaintiffs or Defendants shall file joint motions with co-parties unless there are clear conflicts of position. The applicable pages limits for individual parties shall apply for joint pleadings absent leave of court.

Calendar Call: Our Calendar Calls are typically held on the Wednesday prior to the commencement of the two-week trial period at 9:30 a.m., unless otherwise noted.

The Court will not set a pretrial conference.

The Court will set the case for trial following receipt of the parties’ joint scheduling report and scheduling order.

Counsel for each party shall appear in person for hearings on all substantive motions. With prior permission from the Court, counsel residing outside of Miami-Dade and/or Broward Counties may appear by telephone for status conferences and calendar calls.

The Court refers all discovery matters to the Magistrate Judge. See attached procedures for Magistrate Judge Goodman.

If a settlement is reached in your cases, please immediately contact chambers and file a notice of settlement with the Court.

Proposed Orders: Parties shall submit all proposed orders in Microsoft Word format to gayles@flsd.uscourts.gov.

Electronic Equipment: Parties requiring the use of electronic equipment in a hearing or trial shall file a motion with the Court listing the items needed and the names of the attorneys and/or staff who will be using the equipment.

Criminal Procedures

Calendar Call: Our Calendar Calls are typically held on the Wednesday prior to the commencement of the two-week trial period at 9:30 a.m., unless otherwise noted.

Unless otherwise approved by the Court, defendants on bond must be present at all hearings and court conferences.

The parties shall file all motions for variance and any objections to the presentence investigation report 14 days prior to the scheduled sentencing date.

If a sentencing hearing is expected to last more than 30 minutes, which should be very rare, the court must be notified at least 7 days prior to the sentencing date, as noted in the paperless notice of sentencing, so that sufficient time is set aside.
